Terms of Service for Gamble AI

Welcome to Gamble AI (“we,” “our,” “us”). By downloading, accessing, or using the Gamble AI mobile application (the “App”), website, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. Purpose of the App

Gamble AI is an educational and analytical platform designed to help users understand the mathematics, probability, and decision-making principles behind games of chance such as poker, blackjack, and similar.

• The app does not enable, facilitate, promote, or support real-money gambling.
• You may not use Gamble AI while actively participating in real-money or online gambling.
• The app is designed solely as a training tool and educational coach for improving statistical reasoning, strategy, and game theory understanding.
• Gamble AI is not affiliated with any casino, sportsbook, or online gambling service.

2. Eligibility

To use Gamble AI, you must:

• Be at least 18 years of age, or the age of legal majority in your jurisdiction.
• Have the legal capacity to enter into binding contracts.
• Not be barred from using the Service under applicable laws.

By using the app, you represent that you meet all these requirements.

3. No Gambling or Betting

You agree that:

• You will not use Gamble AI during or in connection with any form of real-money gambling, including online poker, blackjack, sports betting, or casino play.
• The Service does not provide gambling functionality, betting systems, or the ability to wager or win money.
• Gamble AI is for educational, analytical, and entertainment purposes only.
• Any advice, probabilities, or insights offered are theoretical simulations and should not be used to influence real-money wagers.

Violation of this clause may result in immediate termination of your account and possible reporting to appropriate authorities if required by law.

4. User Responsibilities

You agree to use Gamble AI lawfully and responsibly. Specifically, you will not:

• Use the app while gambling for money.
• Attempt to integrate Gamble AI into online casinos or gambling platforms.
• Circumvent, disable, or interfere with security features.
• Reverse-engineer, copy, or resell the software or its AI algorithms.
• Use the Service to defraud, mislead, or harm others.
• Upload or transmit viruses, malware, or malicious code.
• Engage in activity that could disrupt or damage the Service.

We reserve the right to suspend or terminate access to any user who violates these terms.

5. Educational and Informational Disclaimer

Gamble AI is not a gambling tool, not a financial advisor, and not a guarantee of success in any form of gaming or gambling.

• All probabilities, simulations, and analyses are approximate, educational, and non-binding.
• The app is intended to teach mathematical reasoning and probability concepts only.
• You are solely responsible for any decisions you make, whether related to gaming, finances, or otherwise.
• We are not responsible for any losses, damages, or consequences arising from the use or misuse of Gamble AI.

6. No Warranties or Guarantees

You understand and agree that:

• Gamble AI makes no guarantees that its strategies or predictions will produce any particular outcome.
• All data, insights, and analytics are for simulation and training purposes only.
• We do not warrant that the app will be error-free, secure, or uninterrupted.
• The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
• To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by law, Gamble AI and its affiliates, owners, employees, and agents shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including:

• Financial losses (including gambling losses)
• Lost profits or data
• Reputational harm
• Any result of reliance on app content or coaching

Our total aggregate liability for any claim arising from your use of the app shall not exceed the amount paid by you for the app or subscription within the past 12 months, or $50 USD, whichever is greater.

8. Intellectual Property

All content, software, AI models, data, graphics, and design elements in Gamble AI are the exclusive property of Gamble AI. Users are granted a limited, non-transferable, non-exclusive license to use the app for personal, non-commercial, educational purposes only.

You may not:

• Copy, distribute, or modify any part of the app.
• Reproduce or resell app data or analytics.
• Use any Gamble AI content in connection with third-party gambling or betting products.

All trademarks, logos, and brand names remain the property of their respective owners.

9. Subscription and Payments

If you purchase a subscription or premium plan:

• Payments are processed securely through Apple’s in-app purchase system.
• We do not collect or store full payment information.
• Subscriptions automatically renew unless canceled via your Apple account at least 24 hours before renewal.
• Refunds are handled directly through Apple according to App Store policy.

10. Account Termination

We reserve the right to suspend or terminate your account, without prior notice, if:

• You violate any part of these Terms.
• You use the app for or during real-money gambling.
• You attempt to misuse the Service for unlawful purposes.

Upon termination, you must cease all use of the Service and delete the app from your device. Sections 6–13 of these Terms will survive termination.

11. Privacy

Your privacy is governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described there.

12. Indemnification

You agree to defend, indemnify, and hold harmless Gamble AI, its officers, employees, contractors, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including attorney’s fees) arising from:

• Your use or misuse of the app.
• Your violation of these Terms.
• Any claim that your actions using the app infringed or violated another party’s rights or laws.

13. Legal Compliance

You agree to comply with all applicable local, state, federal, and international laws regarding your use of Gamble AI. You are solely responsible for ensuring that your use of the Service is lawful in your jurisdiction. If your local laws prohibit the use of tools related to gambling education or analysis, you must not use the app.

14. Dispute Resolution and Arbitration

Any disputes arising from or relating to these Terms or the use of Gamble AI will be resolved through binding arbitration in Texas, U.S.A., under the rules of the American Arbitration Association. You waive your right to a jury trial and agree that class actions are not permitted. Each party bears its own costs, and any judgment rendered may be entered in any court of competent jurisdiction.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

16. Disclaimer Regarding Third-Party Content

The app may reference or display third-party data (e.g., example hands, simulated odds, or learning exercises). These are for illustrative and educational purposes only. We do not endorse or guarantee any third-party information, links, or services.

17. Modifications to the Terms

We may modify or update these Terms at any time. Updates will be posted within the app with a new “Effective Date.” Continued use after updates constitutes your acceptance of the new Terms.

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, represent the entire agreement between you and Gamble AI regarding use of the Service and supersede all prior agreements or understandings.
